1. Acceptance of terms
These Terms of Use ("Terms") are an agreement between you and Sikorbit ("Sikorbit," "we," "us"). They govern your use of our website at sikorbit.com, our mobile and web applications (the "Apps"), and related services (together, the "Services"). By downloading, installing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
2. License to use our apps
Subject to these Terms, Sikorbit grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps for your personal or internal business purposes on devices that you own or control. If you downloaded an App from the Apple App Store, this license is limited to Apple-branded products you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the Apps, except where such restrictions are prohibited by law.
3. Accounts
Some features require an account. You are responsible for keeping your login details secure and for activity under your account. Provide accurate information and let us know at support@sikorbit.com if you suspect unauthorized access. You can delete your account at any time — see Account & Data Deletion.
4. Subscriptions & purchases
- Auto-renewing subscriptions. Some Apps offer auto-renewable subscriptions. Payment is charged to your Apple Account (or Google Play account) when you confirm the purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period, at the price shown at purchase.
- Managing and cancelling. You can manage or cancel subscriptions in your App Store account settings after purchase. Deleting the App does not cancel a subscription.
- Free trials. If offered, any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds. App Store purchases are processed by Apple, and refund requests are handled by Apple under its policies at reportaproblem.apple.com.
- Price changes. We may change subscription prices. You will be notified in advance as required by the App Store and applicable law.
5. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Post or share content that is abusive, harassing, hateful, sexually explicit, or infringes the rights of others.
- Interfere with or disrupt the Services, servers, or networks, or attempt to gain unauthorized access.
- Use bots, scrapers, or automated means to access the Services without our permission.
Where an App lets users share content, we provide tools to report objectionable content and block abusive users, and we act on reports. We have zero tolerance for objectionable content or abusive users and may remove content and suspend accounts that violate these Terms.
6. Your content
You keep ownership of content you create or upload. You grant Sikorbit a limited license to host, store, and display that content only as needed to operate and improve the Services. You are responsible for the content you share.
7. Drones, robots & safety
Our Apps may be used to control or monitor Sikorbit drones and robots. Telemetry, video, and autonomous features are provided for convenience and may not always be real-time or exact. When you operate a Sikorbit drone or robot, you agree to:
- Follow aviation and local laws. You are responsible for registering your drone where required, holding any required pilot certification, and obeying airspace, altitude, and line-of-sight rules set by your local aviation authority.
- Respect other people's privacy. Do not use cameras or sensors to record people or private property without permission, or in any way that breaks the law.
- Supervise autonomous operation. Autonomous and assisted features do not replace your judgment. Stay ready to take manual control, and keep people, animals, and property at a safe distance.
- Use products as intended. Operate and maintain hardware according to its manual, and do not modify it in ways that compromise safety.
Do not rely on the App as a safety device. Hardware products, including early-access and prototype units, are covered by the separate terms provided with them.
8. Intellectual property
The Services, including software, design, text, graphics, logos, and trademarks, are owned by Sikorbit or its licensors and are protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.
9. Apple App Store terms
If you downloaded an App from the Apple App Store, the following also applies:
- Acknowledgement. These Terms are between you and Sikorbit only, not with Apple Inc. ("Apple"). Sikorbit, not Apple, is solely responsible for the App and its content.
- Scope of license. The license granted to you is limited to using the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
- Maintenance and support. Sikorbit is solely responsible for providing maintenance and support for the App, as described on our Support page. Apple has no obligation to provide any maintenance or support services for the App.
- Warranty. Sikorbit is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Product claims. Sikorbit, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property rights. If a third party claims that the App or your use of it infringes that third party's intellectual property rights, Sikorbit, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
- Developer contact. Questions, complaints, or claims about the App can be directed to Sikorbit at support@sikorbit.com.
10. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the maximum extent permitted by law, Sikorbit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the 12 months before the claim, or USD $50, whichever is greater. Some jurisdictions do not allow these limitations, so they may not apply to you.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Sections that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Sikorbit is established, without regard to conflict-of-law rules, except where the consumer protection laws of your country of residence require otherwise.
14. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, notify you through the Services or by email. Continued use of the Services after changes take effect means you accept the updated Terms.
